This Privacy Policy describes (i) the types of Personal Information, defined below, that we, our subsidiaries, and affiliates (collectively “Uprise Health”) collect from and about you when you visit this Site or use one of our mobile applications (collectively “Sites”), and (ii) our practices for collecting, using, maintaining, protecting, and disclosing that information. The term “Personal Information” refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household. Personal Information does not include information that is publicly available, de-identified, or aggregated.
Please review our Privacy Policy carefully to understand how we collect, use, protect, or otherwise handle your Personal Information in accordance with using the Sites. By accessing or using the Sites, you agree to this Privacy Policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Sites after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.
This Privacy Policy does not govern Personal Information that is protected health information, as defined by the Health Insurance Portability and Applicability Act of 1999, as amended, and that is collected in connection with the provision of clinical services, employee assistance services, or health plan benefits, which are subject to a separate Notice of Privacy Practices available at https://americanbehavioral.com/notice-of-privacy-practices/.
1. Introduction
When you visit our Sites, we collect several different types of Personal Information for various purposes. This policy applies to information we collect:
- On our Sites.
- In an email, text, and other electronic messages between you and our Sites.
- When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.
It does not apply to information collected by:
- Us offline or through any other means including on any other website operated by Uprise Health or any third party (including our affiliates and subsidiaries); or
- Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or through our Sites.
2. Information We Collect About You and How We Collect It
We may collect several types of information from and about users of our Sites, including information:
- By which you may be personally identified, such as name, postal address, email address, telephone number, and any other identifier by which you may be contacted online.
- Information that identifies a device’s location (geolocation information).
We may collect this information:
- Directly from you when you provide it to us.
- Automatically as you navigate through the Site. Information collected automatically may include usage details, IP addresses, and information collected through cookies and other tracking technologies.
- From third parties, for example, your employer and our customers.

The technologies we use for this automatic data collection may include:

- Web Beacons. Pages of our Site may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
We do not collect Personal Information automatically, but we may tie this information to Personal Information about you that we collect from other sources, or you provide to us.
5. How We Use Your Information
We may use information that we collect about you or that you provide to us, including any Personal Information:
- To present our Site and its contents to you, including customizing your experience on the Sites.
- To provide you with information, products, or services that you request from us or that you view or engage with on our Sites.

6. Disclosure of Your Information
We may disclose aggregated information about our users and information that does not identify any individual, without restriction.
We may disclose Personal Information that we collect, or you provide as described in this Privacy Policy:
- To provide you with services and fulfill our contracts with you.
- To our subsidiaries and affiliates, in compliance with applicable privacy laws.
- To contractors, service providers, and other third parties we use to support our business, and who are bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.
- To a buyer or other successor in connection with or during negotiations of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Uprise Health’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Uprise Health about our Site users is among the assets transferred.
- For any other purpose disclosed by us when you provide the information.
- With your consent.
We may also disclose your Personal Information:
- To comply with applicable laws and regulations.
- To comply with any court order, search warrant, subpoena, or other legal process, as permitted by apply law, including to respond to any government or regulatory request.
- To protect our rights, including to enforce or apply our Terms of Use and other agreements, including for billing and collection purposes.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Uprise Health, our customers, or others.
7. Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:
- Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
- Widgets. We may allow social media companies (e.g., Facebook) to put “widgets” on our Site. These third-party tools may also be used to track you across websites. For example, so long as you are logged in to Facebook, every time you land on a webpage that has a Facebook widget, Facebook will know you’re on that webpage. Uprise Health does not control the privacy practices of these third parties.
- Web Beacons. Web beacons are small pieces of data that are embedded in images on a website. Web beacons may involve the transmission of information directly to us, to another party on our behalf, or to another party in accordance with its Privacy Policy.
- Log Files. Log files are pieces of information that let us know how users are accessing the Site. For example, each time you visit our Site, we may create a log file that tells us that someone visited the page. We use log files to create aggregate reports of Site activities, which means we take that information and add it together to report on all Site activity.
We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt-out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.
Residents of certain states, such as California, Nevada, Colorado, Connecticut, Virginia, and Utah, may have additional Personal Information rights and choices. Please see Your State Privacy Rights for more information.
8. Do Not Track
Because there is not yet a consensus on how companies should respond to web browser-based do-not-track mechanisms, our system will not recognize or respond to Do Not Track requests or headers at this time.
9. Retention of Data
Uprise Health will retain your Personal Information only for a minimum of 12 months for the purposes set out in this Privacy Policy. We will retain and use your Personal Information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
We may aggregate your Personal Information. We may also de-identify your Personal Information so that it is no longer linkable to you. We may use/share any of your de-identified Personal Information at our sole discretion. We commit to you that we shall maintain this data in its de-identified form.
10. Security Of Data
We are committed to the protection of your Personal Information and have implemented reasonable physical, technical, and administrative safeguards to help prevent the unauthorized access to, use of, and disclosure of, your Personal Information. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Site. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.
11. Our Policy Toward Children
The Site is not intended for use by children under 18 years old (collectively “Children,” individually a “Child”). We do not knowingly collect any Personal Information from Children, unless a parent or legal guardian provides such information on behalf of the Child. If you are a parent or guardian and you are aware that your Child has provided us with Personal Information, please contact us. If we learn that we have collected Personal Information from Children without parental consent, we will take steps to delete such information from our servers. You can visit the Federal Trade Commission’s website to learn about the Children’s Online Privacy Protection Act (COPPA).
12. Opt-Out Preference Signals and Global Privacy Controls
An opt-out preference signal grants you the ability to use a browser addon that will automatically communicate your privacy preferences to us once it is installed. 13. Email Communications
The CAN-SPAM Act gives recipients of commercial email the right to have emails stopped from being sent to them. You may unsubscribe from our marketing communications by clicking the “unsubscribe” link found in every commercial email we send, or (if you have an account with us) by sending a request to unsubscribe to Marketing@UpriseHealth.com. If you opt-out of receiving our marketing email communications, we may still send you email messages related to your account or specific transactions with us. Unsubscribing yourself from our marketing emails will not affect our service to you.
Emails that we and our marketing service providers send may include tracking tools that provide us with information related to whether you’ve opened an email or clicked on a link contained in an email.
14. Links To Other Sites
Our Site may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.
We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.
15. Your State Privacy Rights
State consumer privacy laws may provide their residents with additional rights regarding our use of their Personal Information. California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our mobile application that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:

Colorado, Connecticut, and Virginia also provide their state residents with rights to:
- Correct inaccuracies in their Personal Information, taking into account the information’s nature and processing purpose.
- Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

16. Changes To This Privacy Policy
It is our policy to post any changes we make to our Privacy Policy on this page with a notice that the Privacy Policy has been updated on the Site home page. If we make material changes to how we treat our users’ Personal Information, we will notify you by email to the email address specified in your account and/or through a notice on the Site home page or in our mobile application. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Site and this Privacy Policy to check for any changes.

Your California Rights

This document outlines additional privacy rights or requirements under California law and are in addition and made part of our Websites Privacy Policy available here.
Right to Opt-Out of the Sale and Sharing of Your Personal Information.
California residents may opt-out of the sale of their Personal Information (as defined in the Websites Privacy Policy) or the sharing of their Personal Information for cross-context behavioral advertising. To opt-out, download and use a browser supporting the Global Privacy Control (“GPC”) browser signal. If you choose to use the GPC signal, you will need to turn it on for each browser you use.
Right to Limit the Use of Your Sensitive Personal Information.
If you are a California consumer, you may direct us to limit the use of your Sensitive Personal Information (as defined by Civil Code § 1798.140(ae)) to uses that are reasonably necessary to provide our goods and services, or as needed:
- To ensure security and integrity;
- For short-term, transient use, including for non-personalized advertising;
- To maintain or service accounts, provide customer service, process or fulfill orders and transactions, verify customer information, process payments, provide financing, provide analytic services, provide storage, or other similar services; and
- To verify or maintain the quality or safety of a service or device owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance such services or devices.
We do not use your Sensitive Personal Information beyond the purposes necessary to perform functions of our business. As such, this right is not applicable.
Right to Request More Information.
This Privacy Policy discloses our practices with respect to the collection of your Personal Information. In addition to these disclosures, you may also submit a request to know the following information collected during the 12 months prior to your request: (1) the specific pieces of Personal Information we have collected about you; (2) the categories of Personal Information we collected about you; (3) the types of sources from which we collected your Personal Information; (4) the categories of third-parties to whom we sold, shared, or otherwise disclosed information about you; and (5) the business or commercial purposes for collecting your Personal Information, as defined under California Civil Code Section 1798.83(e) (a/k/a the “Shine the Light Law”), during the preceding year for third-party direct marketing purposes.
Please note that due to the different requirements of the applicable laws, our response times may vary depending on the specific type(s) of information sought. We respond to all verifiable requests for information as soon as we reasonably can and no later than legally required.
Right to Request Deletion of Your Personal Information.
You have the right to request that we delete your Personal Information. Following receipt of a verifiable request, we will let you know what, if any, Personal Information we can delete from our records. We will also notify our service providers and contractors, and any third parties to whom we have transferred your information about your request to delete. If we cannot delete all of your Personal Information, we will let you know why.
Right to Correct Inaccurate Information.
If you believe that any of the Personal Information we maintain about you is inaccurate, you may submit a request for us to correct that information. Upon receipt of a verifiable request to correct inaccurate Personal Information, we will use commercially reasonable efforts to correct the information as you direct.
Right to Non-Discrimination for the Exercise of Your Privacy Rights.
If you choose to exercise any of your California rights, you have the right to not receive discriminatory treatment by us.
Submitting Requests Relating to Your California Rights.
California residents may submit requests relating to your Personal Information as described below by submitting a request by email to Compliance@UpriseHealth.com, or by calling us at 1-(800)-395-1616.
To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your Personal Information or complying with any of the requests described below. To verify your identity, we may require you to provide certain information we are likely to already have on-file about you based on the type of relationship you have with us. If you already have an account, we may require you to use that account as part of the verification process. If you exercise your right to request specific pieces of your Personal Information, we will require you to sign a declaration under penalty of perjury that you are the consumer whose Personal Information is the subject of the request.
